This Privacy Policy details how we collect, hold, use, disclose, and protect personal information obtained from clients, prospective clients, individuals using our website and online enquiry form, our contractors, and other individuals with whom we interact.
1.2 By accessing our website, completing our online enquiry form, engaging our services, or otherwise providing personal information to us, you acknowledge and consent to the terms of this Privacy Policy.

2.3 For job applicants, employees, and contractors, we may also collect:

Employment and educational history, referees, Tax File Number, and superannuation information;

2.4 We do not routinely collect "sensitive information" (as defined in the Privacy Act), unless it is necessary for our activities and you have consented or it is otherwise required or permitted by law. We will take additional precautions with sensitive information as required by law.

3.1 We ordinarily collect your personal information directly from you, such as when:

4. PURPOSES FOR WHICH PERSONAL INFORMATION IS COLLECTED, HELD, USED AND DISCLOSED

5.3 Information subject to legal professional privilege and client confidentiality will not be disclosed unless instructed by the client or required/permitted by law.
5.4 We do not sell or rent your personal information to third parties.
6. DATA BREACH RESPONSE AND NOTIFIABLE DATA BREACHES
6.1 We take the security of your personal information seriously. If we suspect that a data breach has occurred involving your personal information, we will assess the circumstances and, where required under the Privacy Act's Notifiable Data Breaches (NDB) scheme, notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.

7. USE OF OUR WEBSITE, ONLINE ENQUIRY FORM, AND COOKIES

7.2 Cookies are small files installed on your device. You may set your browser to refuse cookies, but some parts of the website may not function properly as a result.
7.3 If you use our online enquiry form, the following collection notice applies (APP 5 Collection Notice):
“We collect your personal information (such as your name, contact details, and any matter details you submit) through this form to respond to your enquiry and provide you with legal services. If you do not provide this information, we may be unable to respond. For further details on how we collect, use, and disclose your personal information, including how you can access or correct your information or make a privacy complaint, please read our Privacy Policy.”
7.4 Our website may include links to third-party websites. We are not responsible for the privacy practices or content of external sites.
8. CROSS-BORDER USE OF PERSONAL INFORMATION
8.1 Ordinarily, your personal information will be obtained, accessed, processed, and stored in Australia or Malaysia.
8.2 We will only disclose or transfer personal information to other countries where it is necessary for the provision of legal services, administrative functions, or to comply with legal or regulatory obligations.
8.3 We are committed to complying with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) in relation to all personal information, regardless of where it is handled or stored. We take reasonable steps to ensure that any overseas handling of personal information provides a level of protection substantially similar to that afforded under the APPs.
8.4 We will not disclose personal information to any third party located overseas unless:

the disclosure is required for the performance of legal services or related administrative activities;

the disclosure is otherwise required or authorised by law.
9. PROTECTION, STORAGE AND RETENTION OF PERSONAL INFORMATION
9.1 We take reasonable steps to protect your personal information against loss, misuse, unauthorised access, disclosure or modification, and interference through:

Physical security at our postal address in Ultimo, New South Wales;

Password-protected hardware and online systems;

Secure online storage of documents on Google Drive;

Archiving or destruction of documents no longer required, except as required by law or professional obligations (typically at least 7 years for legal records).
9.2 Where personal information is held by third-party providers, we take reasonable steps to ensure they meet appropriate standards of security.
10. DIRECT MARKETING
10.1 We may, from time to time, send you updates, newsletters, or marketing materials in relation to our services where you have requested such communications or it is otherwise lawful to do so.
10.2 You may opt out of receiving marketing communications at any time by contacting us or using the unsubscribe facility provided in the communications.
11. ACCESS AND CORRECTION OF PERSONAL INFORMATION

11.2 We will take reasonable steps to correct your personal information if you believe it is inaccurate, out-of-date, incomplete, irrelevant or misleading. If we deny access or refuse to correct the information as requested, we will provide reasons for the refusal as soon as practicable and explain how you can complain about the decision.
11.3 No fee applies for making a request for access or correction, but we may charge for reasonable administrative costs if applicable.
12. COMPLAINTS HANDLING

12.2 We will acknowledge receipt of your complaint within 7 days. We aim to resolve complaints as soon as practicable, generally within 30 days. If your complaint is complex or requires further information, you will be informed of any delays.
12.3 If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC). See: www.oaic.gov.au or phone 1300 363 992.
13. ANONYMITY AND PSEUDONYMITY
13.1 Where lawful and practicable, you may interact with us anonymously or under a pseudonym (for example, when making a general enquiry). However, for most legal services, it will not be practicable for you to remain anonymous or use a pseudonym.
14. CHANGES TO THIS POLICY
14.1 This Privacy Policy may be updated, amended, or replaced from time to time to reflect changes in legal or business requirements. The latest version is available on our website. We recommend that you review the policy periodically.
